In essence, the Temporary Domestic violence protection Order freezes the “status quo” when the divorce is filed.  With that said, a marriage is like the wild west before the Temporary Domestic Order is filed and served.  Before the Temporary Domestic Order is filed and served, either spouse can potentially cancel accounts, withdraw money, or make changes without violating a court order.

Moreover, money that is spent during the marriage is presumed to be community debt.  Accordingly, money that either spouse spends on entertainment, dinning, or vacations may be found to be community debt.  For this reason, it is essential to monitor accounts when divorce is looming.  Failing to monitor accounts could lead to mounting debt that the court calls community. In doing so, the court can split the community debt 50-50.
