DOMESTIC VIOLENCE AND CHILD CUSTODY

There’s no way around it, domestic violence impacts child custody.  Child custody and visitation are always based on a child’s best interests.  Because of this fact, the court considers several factors that impact a child’s best interest.

New Mexico courts consider domestic violence when determining a child’s best interests.  Is domestic violence present in your marriage or relationship?  Has a Restraining Order of Protection been entered against the abuser?  If so, the court could grant sole legal custody or require supervised visitation.

Regarding supervised visitation, NM courts believe that children are best served when raised by both parents.  Accordingly, even when abuse is present, the court usually will allow supervised visitation.  Moreover, the court may order for the visitation or exchanges to take place at a neutral, supervised location.

At times, abuse rises to a level where visitation must be suspended.  In these situations, the court may order for visitation, if any, to take place under therapeutic supervision.  Additionally, the court may order for reintegration counseling to take place.

HOW FAMILY COURT JUDGES SPOT PROBLEMS AT HOME

  • Domestic violence at home;
  • CYFD or police involvement;
  • Unstable/dangerous people in a home; or
  • Child’s disclosures.
