Do I Need a Divorce Attorney for Men/Women Only in Albuquerque,New Mexico?

Are you going through a divorce and are wondering, “Do I Need a Divorce Attorney for Men/Women Only in Albuquerque,New Mexico?”  If so, you are not alone.

Increasingly, commercials that promote divorce attorney for men/women have hit the airwaves.  Before this national advertising campaign hit Albuquerque,New Mexico, the concept of an attorney for men or women only was virtually unknown.  Now, the concept of a divorce attorney for men/women only seems to be an absolute must.

The concept of a divorce or custody lawyer for men/women only is fascinating.  It’s fascinating how advertisements shape our concept of what is normal, needed, or necessary.  Anyways, let’s explore this concept and see if the ad campaign makes any sense.

DO YOU WANT A DENTIST OR ACCOUNTANT FOR MEN/WOMEN ONLY IN ALBUQUERQUE,NEW MEXICO?

I have several dentist friends in albuquerque,New Mexico?.  Additionally, I commonly see dental advertisements and sometimes receive pamphlets in the mail for dental providers.  With that said, I have never seen a commercial that advertises dental services for men/women only.  I would be surprised if there is such a demand.  Possibly, I suppose.

The concept of a dentist, accountant, or architect that would only represent men or women never crossed my mind.  Then again, the concept hasn’t crossed my mind because I haven’t experienced a national advertising campaign for accountants that only serve men or women.  For whatever reason, there seems to be a demand for lawyers that will only represent men or women.

FOCUSING ON DIVORCE ATTORNEYS FOR MEN/WOMEN ONLY IS A RED HERRING

A red herring is something that misleads or distracts from an important question.

Television ads that focus on a client’s gender distract from important questions about the attorney.  For instance, here are some of the important considerations for picking an effective divorce attorney:

  • Experience;
  • Reputation;
  • Knowledge;
  • Dependability;
  • Work ethic;
  • Personality;
  • Intelligence;
  • Trial experience that creates the ability to spot and eliminate potential issues;
  • Experience to guide clients towards a desired outcome; and
  • An attorney that is willing to give you both the good and the bad.

Any divorce attorney can tell you what you want to hear.  Any freshly minted attorney — without a moment of trial experience – can passionately tell you that he/she only represents men/women.  Rookie lawyers from other states come and go. Out of state firms and advertising campaigns usually pass-through New Mexico and then move along.

Skills matter.  Knowledge matters.  Experience matters.  Whether the skilled attorney is a man or a woman usually does not matter.  Memorable slogans and campaigns do not change an attorney’s experience and ability.

With that said, here is the million-dollar question: Do you have a problem working with men or women? If you do, then you probably shouldn’t hire a male or female lawyer.  For instance, if you dislike men or cannot work with men, then you probably should hire a female lawyer.  With that said, hire a female lawyer based on her ability – not because she refuses to represent men or women.

ONLY REPRESENTING MEN OR WOMEN DOESN’T CHANGE THE FACTS

Some cases have good facts.  Alternatively, some cases have bad facts.  For instance, some cases involve parents with substance abuse, domestic violence, or severe mental health issues.  Moreover, some cases involve parents that have never established a relationship with their child.  Other cases involve Restraining Order of Protections.  Despite these drawbacks, the parent may be seeking an unrealistic goal, including:

  • 50-50 parental visitation;
  • Visitation that never occurred after the couple separated; or
  • Visitation that is not in the child’s best interests – based on the facts.

Memorable television ads don’t change a case’s facts.  Catchy sound bites about hard-hitting lawyers that only represent men doesn’t change the following:

  • New Mexico law and procedure;
  • The assigned judge’s personal beliefs; or
  • Courtroom procedure and policies.

Despite these issues, some advertisements suggest that the problem doesn’t rest with a case’s facts.  Instead, the root problem is that a lawyer willing to represent both women and men will not fight hard enough for a man’s rights.

Unfortunately, parents do not have a right to 50-50 parental visitation.  In fact, parents don’t have an inherent right to any visitation. Visitation is always based on a child’s best interests.  In this respect, a child’s best interests depend on several factors that vary with each case.

FIND AN EXPERIENCED DIVORCE ATTORNEY THAT CONNECTS WITH YOUR CASE

Attorney advertisements are everywhere.  As an experiment, take a trip down either I-25 or I-40.  Along the way, count the number of divorce attorney billboards on your trip.  I hope that you have a lot of fingers, because there will be a lot of lawyer billboards.  I’ve even seen attorney advertisements on pizza boxes.

There’s no way of escaping it, lawyer ads are everywhere.

Apparently, a marketing wizard discovered a winning formula about hard-hitting attorneys that only represent men.  After this discovery, ads about “Attorneys for Men” are crossing the globe.  In turn, mothers and fathers are left with the impression that their case is best suited by an attorney that only represents one gender.

Don’t believe the media hype.  Instead, look for an experienced divorce attorney that connects with your case.  Whether male or female, find an attorney that is willing to tell you what you need to hear – and not what you want to hear.  In doing so, look for an attorney with the trial experience that is needed to understand your case’s issues.
